Terms of Service

1. Services

ViaHause provides real estate agents and teams with hosted listing showcase pages, including customizable microsites, branding tools, and lead capture features (the "Services"). Access is granted through a paid subscription or as part of a bundled product offering.

2. Account Registration

To use the Services, you must complete the onboarding process and provide accurate, current information including your name, email, phone number, and California DRE license number. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Acceptable Use

You agree to:

• Use the Services only for lawful purposes related to real estate marketing.
• Only publish listings that are yours or for which you have express written consent from the listing agent.
• Provide accurate property information and comply with all applicable MLS rules, California Department of Real Estate regulations, and fair housing laws.
• Not use the Services to transmit spam, malware, or any content that infringes on the rights of others.

4. Content & Intellectual Property

You retain ownership of the content you upload to ViaHause (photos, text, logos, headshots). By uploading content, you grant us a non-exclusive, worldwide license to host, display, and distribute that content solely for the purpose of operating the Services on your behalf. We retain all rights to the ViaHause platform, brand, design templates, and underlying technology.

5. Fees & Billing

Subscription fees are billed in accordance with the plan selected at checkout. All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days' advance notice. Continued use of the Services after a pricing change constitutes acceptance.

6. Termination

You may cancel your account at any time by contacting us at support@viahause.com. We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users or to the Company. Upon termination, your listing pages will be deactivated and your data will be handled in accordance with our Privacy Policy.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available." We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, HousePilot Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to lost profits, lost data, or business interruption. Our total liability for any claim arising from these Terms shall not exceed the fees you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless HousePilot Inc., its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Services, your content, or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Santa Clara County, California.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
